There are a number of different options available to a person experiencing marital breakdown, including:

Separation Agreements occur without any Court proceedings and are a contract between the parties to regulate the manner of the breakdown of the marriage.
Any agreement is entered into with the benefit of full financial disclosure along with independent legal advice for both parties. They are also vulnerable to challenge and as a result parties should go to their solicitor to discuss.
It is also important to note that this does not result in court orders being made.

Judicial Separation and Divorce proceedings are broadly similar in form, however there are different requirements before being entitled to apply for either proceeding.
They involve the issuing of proceedings in the Circuit Court or High Court with the end result being to obtain Court Orders which will provide each party with the necessary certainty and finality to assist them in moving forward with their lives post breakdown.
This process involves the making of full financial disclosure by both parties to enable all involved to make an informed decision.

Judicial separation and divorce proceedings can be completed by way of agreement where there are limited issues between parties, in those cases finalising the process is extremely quick.
In cases where proceedings are more difficult and contentious, we engage in negotiations on behalf of our clients in an attempt to avoid the cost and stress associated with Court attendance.
This involves engaging in settlement talks on behalf of our client with the assistance of a Barrister.

Unfortunately, it is not always possible to achieve an agreement and these cases will require a hearing by a Court.
