Hello & Welcome to the Immigration Law team
Thank you for visiting the Immigration section of our website where you can read about our team and the areas we specialise in.
Whether you need assistance with employment permits, visas, naturalisation, citizenship, foreign birth registration, family reunification applications or any type of residency application, we are here to help and guide you through the process.
Please review the information and if you have any questions, please get in touch to find out how we may assist you.
My name is Aileen Gittens and I head up our Immigration team.
I love my work as it gives me great satisfaction to be able to use the law to help people in an area of great importance to their personal lives.
- Sometimes, that involves helping clients realise their dreams of living legally in Ireland, when they had thought all hope of that was lost.
- Sometimes, it involves helping clients bring their family members to live with them in Ireland, often when they had applied themselves but were refused.
- Sometimes, it involves helping a busy industry bring much needed workers to Ireland in roles they had struggled to fill for long periods of time.
Immigration law is rewarding to practice as it is hugely satisfying to help clients with these issues, and it is interesting to practice as it is one of the most dynamic areas in Irish law due to the prolific nature of Irish and European court cases in this area.
I feel privileged to have advised hundreds of clients on various immigration related matters over the last number of years. I am delighted to have established the immigration law department at Poe Kiely Hogan Lanigan, a firm which provides legal service at the highest level across a variety of areas, in the heart of Kilkenny city. I believe we can add huge value for people in need of legal immigration assistance across the south east, and indeed, all of Ireland.
Often one can migrate to Ireland and settle here lawfully without having to engage an immigration solicitor.
However, in many cases, the services of an immigration solicitor can be essential.
The immigration team at Poe Kiely Hogan Lanigan LLP is here to help you if you feel you need assistance with your or your family member’s journey to lawful residence in Ireland.
We have extensive experience in all types of immigration applications and specialise in legal appeals and judicial review proceedings.
Our services extend beyond borders. We can help you whether you live in Kilkenny or Kerry, Ireland or India, or anywhere in between!
Our immigration team will have an initial consultation with you (usually by video call) in order to take full instructions from you. We will listen to your questions and advise you on any immigration pathways available to you to come to Ireland. We will summarise that advice by e-letter to you following the consultation. Thereafter, we will support you in achieving whatever outcome is recommended for you, and we will be here to answer whatever questions you may have along the way.
We can assist you with:
- Providing general immigration advice on your situation
- Drafting and submitting any first instance immigration application on your behalf
- Drafting and submitting any type of immigration review or appeal
- High Court judicial review proceedings
Immigration appeals and High Court Judicial Review proceedings are a crucial aspect of our practice. If you have applied for any type of immigration application and if it has been refused, legal advice at this stage can be invaluable. Your solicitor will advise whether a decision is unlawful and should be challenged and will draft the review or appeal of the impugned decision. A strong review or appeal will deal with each refusal reason and outline, from a legal administrative, immigration and human rights perspective, whether that refusal ground was lawful or not.
If a strong legal review or appeal to a negative decision is not submitted, the applicant will have a negative immigration decision in their name and in some cases, this can taint future applications they may make.
A review or appeal is often the last step to challenge a negative decision outside of the court process. If a review or appeal is refused, in order to challenge that refusal, High Court judicial review proceedings are necessary. It is usually best to exhaust the “review or appeal” option before issuing High Court judicial review proceedings.
Often, High Court judicial review proceedings result in “out of court” settlements, which ultimately result in the relevant application being “re-decided” in our client’s favour.
