Mediation

Mediation is a formal process aimed at facilitating the settlement of a dispute between parties without the Court’s help.

We recommend parties consider engaging in mediation in order to preserve costs and avoid the stress and strain of going to Court.

While Mediation is a formal process, it is important that throughout the process that parties obtain independent legal advice to ensure that any agreement reached will satisfy a Court that both parties have been properly provided for.

Despite best efforts, mediation does not always result in an agreement and in some cases, it may be unsuitable for some parties.

However, in these instances we will continue to endeavour to find an agreement on behalf of our clients.

This will involve settlement talks as part of family law proceedings and negotiating outcomes on behalf of our clients without resulting in a court hearing.

In the round, we believe that the best outcomes are those arrived at by way of agreement between parties, whether through mediation or negotiation with the assistance of legal counsel.

This format involves parties engaging with their separate respective legal advisors and attending at a meeting where they are in separate rooms instructing their legal team.

This will allow clients to feel more at ease and in our experience, many people find this a much easier means of coming to an agreement.
