SURROGACY: Documents Required When Returning With Your New Baby

  1. Confirmation and date that the minor has been registered with a local health centre (as opposed to a clinic/GP clinic) on arrival to this jurisdicition.
  2. Copy of Relevant Orders
  3. Copy of Stamped Motion, Affidavit and Exhibits
  4. Copy of Stamped Civil Bill
  5. Copy of DNA Results
  6. Confirmation as to the dates when each of the DNA samples were provided.
  7. Copy of the full, signed and dated surrogacy agreement.
  8. Confirmation that the birth mother is aware of the origin of the egg.
  9. Please advise if any of the parties are aware of the identity of the egg donor.
  10. Copy affidavit of the spouse of the intended father as to their attitude to the proceedings.
  11. An affidavit of the birth mother stating her maritial status. If she is divorced or widowed, supporting documentation should be supplied.
  12. Confirmation of service of papers for the hearing on the birth mother.
  13. Clarification that full certified translations of all the documents have been included in the proofs.
  14. The spouse of the birth mother should be named as respondent if the birth mother is married.
  15. If the birth mother is married, confirmation of service papers for the hearing on the spouse of the birth mother.
  16. Confirmation of the views of the birth mother in relation to proceedings in this jurisdiction subsequent to service of court papers and pleadings and any affidavit. Confirmation should be written in the vernacular of the birth mother, signed by her and accompanied by a certified English translation.
  17. Confirmation that an independent lawyer has been retained on behalf of the birth mother.
  18. If the birth mother is married, confirmation of the views of the spouse of the birth mother in relation to proceedings in this jurisdiction subsequent to service of court papers and pleadings and any affidavit. Confirmation should be written in the vernacular of the birth mother, signed by her and accompanied by a certified English translation.
  19. Confirmation that the application is limited to the question of paternity only.
  20. Confirmation of the habitual residence of the minors.
  21. Confirmation of any previous applications by the intended father.
  22. Copy of the signed undertaking
  23. Confirmation the Attorney General is joined as a notice party.
  24. Confirmation that costs are not being sought against the Attorney General.
  25. A full and completed copy of the above proofs.
