Surrogacy Update: Health (Assisted Human Reproduction) Bill 2022

The legislative amendments which provide for the recognition of past domestic and international surrogacy arrangements and permitted international surrogacy arrangements have been inserted into the Health (Assisted Human Reproduction) Bill.

The Bill will come before the Health Committee tomorrow Wednesday the 24th of January. 

This legislative amendments provide us with guidance regarding the procedure and requirements that will have to be complied with before the parents of children born through past domestic and international surrogacy arrangements can apply to the High Court for parental orders.

The legislative amendments provide us with guidance regarding the criteria and requirements a surrogacy arrangement must comply with before the Regulatory Authority will provide a pre conception approval authorisation.
